Ms. Tolchin specializes in appeals before the Board of Immigration Appeals and the U.S. Court of Appeals for the Ninth Circuit. She is also admitted to practice before the U.S. Supreme Court, the Tenth Circuit, and the Second Circuit. She has been counsel in a number of decisions addressing such topics as reinstatement of removal, asylum, jurisdiction, challenges to criminal charges of removability, retroactivity, ineffective assistance of counsel, and other due process issues. She also speaks regularly on Ninth Circuit practice to members of the American Immigration Law Association, National Immigration Project of the National Lawyers Guild, and the Los Angeles County Bar Association. Ms. Tolchin acts as a mentor to other attorneys practicing before the Ninth Circuit.
District Court Practice
Ms. Tolchin is admitted to practice before the U.S. District Courts for the Central District of California, Northern District of California, Eastern District of California, and Western District of Washington. She has extensively litigated before the District Courts in cases challenging unlawful detention of noncitizens and petitions for writs of mandamus challenging the unreasonable delay of applications for lawful permanent residency, as well as denials of naturalization. Ms. Tolchin has done trainings for other attorneys on District Court practice and in the filing of petitions for writs of mandamus.

The Law Offices of Stacy Tolchin assists parties and witnesses in civil litigation with obtaining visitor visas in order to appear to attend proceedings in the United States, as well as obtaining nonimmigrant waivers of inadmissibility for individuals who are otherwise unable to come to the United States on a temporary visa.
The Law Offices of Stacy Tolchin provides mentorship and technical assistance to attorneys. Our services include mooting for oral arguments; mentorship in district court, federal litigation practice, and attorneys’ fees: and technical assistance in various matters, including Duran-Gonzalez class members, ABC/NACARA issues, and national security cases. We also work with criminal defense attorneys to advise on immigration consequences of convictions.
In 2015, Ms. Tolchin partnered with UCLA School of Law to establish the two-year immigration law postgraduate fellowship at the Law Offices of Stacy Tolchin. The fellowship was established to afford UCLA Law graduates committed to immigrant rights work the opportunity to receive consistent mentorship and training as young lawyers, enabling them to pursue their commitment to protecting and advancing the rights of immigrants. The fellowship will be open to a UCLA School of Law graduate every two years. The firm will pay the fellow’s salary and benefits, and the fellow will be eligible for the law school’s Loan Repayment Assistance Program (LRAP).
