Ms. Tolchin specializes in appeals before the Board of Immigration Appeals and the U.S. Court of Appeals for the Ninth Circuit. She is also admitted to practice before the U.S. Supreme Court, the Tenth Circuit, and the Second Circuit. She has been counsel in a number of decisions addressing such topics as reinstatement of removal, asylum, jurisdiction, challenges to criminal charges of removability, retroactivity, ineffective assistance of counsel, and other due process issues. She also speaks regularly on Ninth Circuit practice to members of the American Immigration Law Association, National Immigration Project of the National Lawyers Guild, and the Los Angeles County Bar Association. Ms. Tolchin acts as a mentor to other attorneys practicing before the Ninth Circuit.
District Court Practice
Ms. Tolchin is admitted to practice before the U.S. District Courts for the Central District of California, Northern District of California, Eastern District of California, and Western District of Washington. She has extensively litigated before the District Courts in cases challenging unlawful detention of noncitizens and petitions for writs of mandamus challenging the unreasonable delay of applications for lawful permanent residency, as well as denials of naturalization. Ms. Tolchin has done trainings for other attorneys on District Court practice and in the filing of petitions for writs of mandamus.
